Background

 

Mr. Hoornstra served as a WERC Commissioner from 1976-1978.  In that time, he also served as a hearing examiner, mediator, and arbitrator in a wide range of grievances.  He served as an interest arbitrator and fact finder for the Iowa Public Employee Relations Board and as an ad hoc WERC arbitrator from 1978-1984.  Before joining WERC, he taught labor law at UW-Platteville and Business Law at UW-Madison.  He was General Counsel for the Wisconsin Chapter of Associated General Contractors from 1970 to 1972, representing the contractors in labor relations matters.

 

Most of his professional life was in the Wisconsin Department of Justice as an Assistant Attorney General from 1972 forward.  In the early years he primarily represented the neutral decision makers (WERC, DILHR/LIRC, and the Personnel Board/Commission).  He has twice appeared before the United States Supreme Court on NLRA pre-emption issues.  Lodge 76 of Machinists v. WERC, 427 U.S. 132 (1976), and Gould, Inc. v. Wisconsin Dept. of Industry, Labor and Human Relations, 475 U.S. 282 (1986).  He also had occasion up to about 1990 to represent state agencies as employers in discrimination suits.  A major portion of his work was in torts and civil rights.

 

Mr. Hoornstra served as Director of Legal Services at UW-Madison from June 2006 through February 2008.  That office was responsible for representing UW-Madison in its employer capacity.  He is a regular contributing author to books of the State Bar of Wisconsin: Civil Damages; Judicial Bench book (Prisoner litigation); and Wisconsin Governmental Claims and Immunities (Sovereign Immunity).  He frequently serves as a moot court judge in UW Law School competition.

 

Fee schedule

 

$600 per 8-hour day (inclusive of breaks) for time spent on pre-hearing services, travel, conduct of hearings or study and preparation of awards.  Travel time from 5021 La Crosse Lane, Madison at current IRS rate for mileage.  Meals and lodging will be billed to the parties.  Any charges for cancelled hotel/motel reservations or fees charged by airlines and travel agents for unused airline tickets will be billed to the parties.  Cancellation: $400 unless one week’s notice.

 

Other Expenses:    Phone calls, postage, typing and copying costs will not be billed to the parties, unless substantial.

 

NOTE:     The arbitrator shall not charge any fee other than the above stated fees.
