

What
documents may be filed with the WERC via fax or e-mail?
Labor Relations Cases -- For
almost all documents, the Commission's administrative rules
for labor relations cases, as revised in 2007, authorize fax or e-mail
filing with the WERC, as optional alternatives to filing by (hand) delivery or
mail. The
Exceptions requiring submission in paper form include a showing of interest supporting a representation election or referendum, a request for an absentee ballot and an absentee ballot itself.
However, where the initiating party is required to pay a filing fee (e.g., complaint, mediation, interest arbitration, fact-finding, grievance arbitration), the petition or service request is not filed until the filing fee is actually received at the WERC Madison office during normal business hours, by (hand) delivery or mail.
Personnel Appeals
Cases -- The Commission's administrative rules for
personnel appeals cases generally call for "papers" to be filed
with the WERC either "personally or by mail." See, e.g., s. PC 1.05,
Wis. Adm. Code. Those rules have been interpreted to allow someone who is
seeking to obtain review of a State civil service personnel action to initiate
a case by fax (as well as delivery by mail or by hand) to the
