Time Limits for Filing Personnel Appeals with the WERC


The term "filing" refers to actual receipt of the appeal by the Wisconsin Employment Relations Commission at its Madison office, rather than simply placing the appeal in a mailbox.

As a general matter, appeals must be filed within 30 calendar days. However, the underlying language establishing the time limit varies according to the type of appeal being filed.

For appeals under Secs. 230.44(1)(a) through (g), Wis. Stats., the time limit is established in s. 230.44(3), Wis. Stats.

For decisions grieved to the Commission as the final step arbiter under s. 230.45(1)(c), Wis. Stats., the time limit for filing is specified in s. ER 46.07(2), Wis. Adm. Code.

The time limit for filing appeals under §230.45(1)(d) and (e), Wis. Stats., is set forth in s. PC 3.01, Wis. Adm. Code.
