Information about Personnel Appeals (including State Civil Service appeals)


Under the State Budget which took effect in July of 2003, the Personnel Commission of the State of Wisconsin was abolished and its authority was divided and transferred to two other state agencies: 1) the Wisconsin Employment Relations Commission (WERC) is now responsible for processing personnel appeals (including State Civil Service Appeals), and 2) the Equal Rights Division (ERD) of the Department of Workforce Development is responsible for processing complaints that were previously the responsibility of the Personnel Commission.

The transferred responsibilities consist primarily of the review of appeals and complaints regarding a variety of personnel actions taken by the State of Wisconsin acting as an employer. Sections 230.44 and 230.45 of the Wisconsin Statutes provide the primary statutory bases for those administrative review processes.

In general, appeals involve challenges by employees to personnel transactions in which the employee tries to show the employer violated the civil service code of the State of Wisconsin. For example, an employee might challenge the results of a promotional examination, arguing that the employer failed to conduct the exam in compliance with criteria found in the civil service code. Appeals are not subject to a pre-hearing investigation by the WERC. For more detailed information about appeals cases and how they are processed, follow the various links listed below. Complaints involve employees' challenges to personnel transactions or conditions of employment on the grounds that the employer discriminated against the employee in violation of some anti-discrimination law. For example, a complaint could involve a challenge to a promotion on the basis of race discrimination. Complaints are subject to an investigation by the ERD.
