SOURCES OF RELEVANT LAW FOR APPEALS  OF STATE CIVIL SERVICE PERSONNEL ACTIONS (PA CASES)


State statutes and administrative rules provide authority for the Commission’s review of State civil service personnel actions.  This page provides links to all statutes and rules that are regularly invoked in PA cases.  The Commission also refers often to its own previous decisions, the decisions of State agencies that preceded the WERC in this area of the law, and relevant decisions of Wisconsin courts.  Those decisions may also be accessed via this page.

Administrative Rules

o        PC 1, 3 through 6, the rules of the Wisconsin Employment Relations Commission relating to the processing of State civil service appeals.  (These rules retain the prefix of “PC” because they were developed by the agency that had previously exercised authority in this subject area.)

o        ER 1 through 47, the rules of the Office of State Employment Relations (OSER), including rules relating to classification issues and the non-contractual grievance procedure.

o        ER-MRS 1 through 34, the rules of the Division of Merit Recruitment and Selection (DMRS) within the Office of State Employment Relations.
