Expedited Arbitration of State Civil Service Classification Appeals


Introduction

Arbitration (instead of a regular civil service proceeding) is an option for employees who file appeals concerning the reallocation and reclassification of positions, the denial of reallocation and reclassification, decisions as to the effective dates of reclassifications and reallocations, and decisions as to the filling of positions by competition or by regrade of the incumbent. The arbitration option is unavailable for other kinds of cases.

Major Differences between  Arbitration and Regular Civil Service Proceedings

1. Arbitration is much faster because a decision is issued at the end of the hearing.

2. The Arbitrator’s decision is almost always the final answer.

3. No discovery is available.
